Terms of Service

Introduction

Welcome to Kahfee ("we," "our," or "us"). By downloading, accessing, or using our mobile application (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

These Terms of Service ("Terms") constitute a legally binding agreement between you and Kahfee regarding your use of the App. Please read these Terms carefully before using the App.

Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the App on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the App following the posting of any changes constitutes acceptance of those changes.

Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this requirement and that you have the right, authority, and capacity to enter into and abide by these Terms.

Account Creation and Security

Registration

To use certain features of the App, you may need to create an account. When registering for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • Restricting access to your account
  • All activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge.

User Content

Content Ownership

Any content you submit, post, or display on or through the App ("User Content") remains your property. By providing User Content to the App, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display such User Content for the purpose of operating and improving the App.

Content Restrictions

You agree not to post, upload, or share any User Content that:

  • Violates any third-party rights, including intellectual property rights
  • Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Contains software viruses or any other code designed to interrupt, destroy, or limit the functionality of any computer software or hardware
  • Is used to impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable federal, state, local, or international law or regulation
  • Attempt to gain unauthorized access to any portion of the App or any systems or networks connected to the App
  • Use any robot, spider, or other automatic device, process, or means to access the App for any purpose
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other harmful material
  • Interfere with or disrupt the App or servers or networks connected to the App
  • Use the App to send unsolicited or unauthorized advertising or promotional materials
  • Engage in any activity that could disable, overburden, damage, or impair the App

Subscription and Billing

Subscription Terms

Kahfee offers subscription services to access premium features. By subscribing to our premium services, you agree to the following:

  • Subscription fees are charged at the beginning of each billing period (monthly, annually, or as otherwise specified)
  • Auto-renewal is enabled by default; you can disable it through your account settings
  • Prices are subject to change with notice, and any price changes will apply to billing periods after the notice

Refund Policy

All purchases are final and non-refundable, except as required by law. If you believe you are entitled to a refund, please contact our support team at support@kahfee.app.

Free Trial

We may offer free trials of our premium services. If you do not cancel before the end of the trial period, you will be automatically charged for the subscription.

Intellectual Property Rights

Kahfee Content

All content included in or made available through the App (including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, and their selection and arrangement thereof) are owned by Kahfee, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Trademarks

The Kahfee name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Kahfee or its affiliates or licensors. You may not use such marks without the prior written permission of Kahfee.

Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the App, or delete your account through the App's settings.

Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PROVIDED BY LAW, KAHFEE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE.

KAHFEE DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KAHFEE OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, COVER OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, REVENUE, GOODWILL, USE OR CONTENT) HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY, INCLUDING, WITHOUT LIMITATION, CONTRACT, TORT, WARRANTY, NEGLIGENCE OR OTHERWISE, EVEN IF KAHFEE HAS BEEN ADVISED AS TO THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to defend, indemnify, and hold harmless Kahfee, its parents, subsidiaries, affiliates, and their respective officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the App shall be brought exclusively in the federal or state courts located in San Francisco, California.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

The failure of Kahfee to enforce any right or provision of these Terms will not be considered a waiver of such right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Kahfee.

Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Kahfee regarding your use of the App and supersede all prior and contemporaneous written or oral agreements between you and Kahfee.
